"A protester is not an interested party where it does not possess the IDIQ contract under which the protested order will be or has been issued". So, how did GAO reach the conclusion that C3.ai was not an interested party? That conclusion at first surprised me! After all, the regulations define an interested party as "an actual or prospective bidder or offeror whose direct economic interest would be affected by the award of a contract or the failure to award a contract." C3.ai sure seems like a prospective offerer, with a direct economic interest, by the award (or failure to award). and lost.īut, here, GAO never reached the question of whether CDC was justified in using Palantir because GAO concluded that C3.ai was not "an interested party" in the award decision. After all, Palantir famously made a similar argument in 2016. The protester argues that, “under the Federal Acquisition Regulation, ‘brand-name specifications shall not be used unless market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.’” C3.ai contends that if the CDC had conducted the required market research, the agency would have found that the protester-and not Palantir alone-can provide a full solution for the agency’s requirements. So, C3.ai protested the SEWP award and argued that CDC should not have required a SDVOSB to use Palantir: C3.ai asserts that CDC’s brand-name justification in support of its decision to limit the SaaS solution license to Palantir Foundry products is improper. And it basically argues that anything it can do anything Palantir can do. It, like Palantir, is an enterprise data platform. All very standard, federal contracting 101 type stuff.Įnter C3.ai. And because these contracts all used Palantir, the government wrote up a brand-name justification for Palantir. So, HHS decided to combine these contracts together and bid the opportunity as a task order under the NASA SEWP GWAC as an SDVOSB set-aside. ![]() Compounding the situation, all 3 of these systems were all contracted through a single "value added reseller" called i3 Federal LLC, and HHS even had a separate contract with Palantir. Under the hood, though, they were all Palantir. You see, over the course of 12+ years, HHS had built 3 different systems with 3 different fun and clever names, and each of them sort of related to data things. Since then, it has expanded to include information regarding therapeutics and at-home test kits (over 500 terabytes of data managed across a few thousand users). Tiberius was created in the summer of 2020 and was tasked with managing the production, delivery, and administration of COVID-19 vaccines to the American public. The current HHS Protect Contract (NNG15SD31B / 75D30122F 13684) was transferred from HHS to CDC in 2022. ![]() HHS has since served as the common operating picture where most COVID-19 data (approximately 1 petabyte of data managed across a few thousand users) is generated from and shared to partners, the White House, and the public. HHS Protect was created in March 2020 by HHS in collaboration with CDC as a data integration, analytics, and situational awareness platform for the whole of Government response to COVID-19-inclusive of information regarding cases, deaths, hospitalizations, diagnostics, and resource planning. A recent award in 2021 enabled CDC to migrate the DCIPHER solution from a CDC on-premises solution to the Palantir Foundry cloud software as a service platform. which all appear to be sort of the same thing? CDC awarded an estimated $19 Million between 20 via contracts to develop, operate, and maintain the DCIPHER solution that today is a configuration of commercial software called the Palantir Foundry. and then continues with another product in 2020 called Tiberius. and then in picks up dramatically at the beginning of the COVID-19 pandemic in 2020 with a product called HHS Protect. Our story begins in 2010 with the creation of a product called DCIPHER. Today, however, we will stay focused on a more narrowly funny thing. Maybe one day I will write about those things. ![]() I thought I might write about the strangeness of setting evaluation criteria for SaaS that is not primarily based on price.īut, no. I thought I might write broadly about GWACs and strategic sourcing and set-aside pools. When I sat down to start writing, I figured I would write primarily about the government-facilitated cottage industry that is value-added resellers. Last week, I announced that I would be writing about the GAO's decision in C3.ai. ![]() Jenia has a much more emotional reaction to this. He's not necessarily positive, but he's acclimating very well to their change in lifestyle, he's just going in the direction the world points him in, as it were. Riley is more open-minded about the whole thing. I thought the film would explore the relationship dynamics between Jenia and Riley and, in a way they do, but it relates more to how each of them adjusts to their current situation. But I digress, I feel the story is more how both Jenia and Riley adjust to their new situation and their surroundings since, basically, Iceland (a country they know nothing about and is completely foreign to them) will now have to act as their home. This story was never told from the point of view of 'we have to figure what went wrong' and therefore not getting answers shouldn't be a drawback. That story wasn't meant to have fight scenes, so I can't complain about it. It'd be like if I complained about the lack of martial arts fight scenes in Romeo and Juliet. So if people disliked the film because there was no explanation, then they're just people with wrong opinions. Jenia and Riley's discussions are more just musings between two people that, literally, have nary a clue as to what the fuck actually happened. But they never mislead you into thinking that they would provide answers. While the characters themselves have existential thoughts about what this all means, why is it them, is there some sort of divine interference here, is it a test and all sorts of other issues. And I don't think the film ever deluded itself or anybody else for that matter. You shouldn't go in expecting any sort of answers. There's absolutely no explanations whatsoever given as to what exactly happened to the world and what led to everyone's disappearance. There's no deus ex machina that involves the earth gaining back its lost population or there's a big revelation that allows Jenai and Riley to, at the very least, go back to the United States. Let's just get this out of the way and there will be SPOILERS (I can put a warning prior to the review on Letterboxd, a little box you click, but not on Flixster), so just look away or something. And I don't mean that to say that there's no real purpose to the film or its narrative, I find the exact opposite to be true, but nothingness and existentialism are some of the biggest themes the film touches upon. ![]() It relates in that you could say that this film is, essentially, about nothing. How does this relate to a film about an American couple, vacationing in Iceland, that find out that they're the only two people left on earth. Jerry Seinfeld was always awful, so I didn't care about him one bit. I think it's a terrible show that makes waste of some really talented comedic actors. I've given it shot after shot after shot and I've never gotten the appeal. I hate Seinfeld with a passion and I still do. I don't like to make statements like that, though I'm probably guilty of them, because that implies that you've seen every comedy series ever made, and not just from your own country. I've heard from many people, and there's no real consensus on this, that they found Seinfeld, a show about nothing, to be the greatest television comedy series of all time. Unfortunately, Ritchey is no longer producing Titanium Breakways of any kind. It's worth considering, too, that Apatow came into the show one of its most seasoned stars. ![]() Maude Apatow, left, is seen with younger sister Iris, mother Leslie Mann, and Paul Rudd in Knocked Up (2007) Universal Lexi has served to this point as a 'good-girl' foil to Rue, so seeing her slowly but surely embrace the wild child spectrum has been a great bit of character development. "Fuck it," Lexi says, before taking a swig of Gatorade/Everclear concoction from the bottle. As the girls got ready to head to Winter Formal, Maddie hopped into the back seat with a Gatorade bottle filled with a certainly-not-Gatorade fluid. A week after playing sounding board to Zendaya's Rue during her big hard-boiled detective/Pepe Silvia rant scene, Lexi's biggest moments came simply sitting in a car, and sitting around a dinner table. Her appearances in the finale, titled "And Salt the Earth Behind You," were undoubtably brief. This moment played for some really great comedy, but the lightness of the scene didn't last long-instantly, as the rest of the episode did, it cut to another time Lexi joining Cassie, silently, solemnly, as she went to the clinic for an abortion. ![]() And it takes a talented performer, like Maude Apatow, who plays Lexi, to pull it off. But it's brief moments like the one described above that make side characters feel less like one-note sketches and more like fully-formed people. Now, obviously, every character in every show can't have their own subplot. ![]() It was brief scene, but one that nonetheless added a little to a character that has gone much of the show's first season existing in support of other characters, seemingly without a storyline or significant interest of her own. "Yeah.OK." *long pause* "I'm going to do that," Lexi said. "Then you go for whoever the fuck you want," Cassie again told her. "But what if they don't?" Lexi asked once again, leaned over and slurring her words as a teenager only drinking alcohol for one of the first few times would. "I don't know, they usually just come to you," Cassie told her. That moment was mid-school dance, when the timid Lexi (Maude Apatow), who had just taken several swigs of a Gatorade/Everclear concoction, asked her popular sister, Cassie, how she decides who to hook up with. But the best pure moment of the week might've actually- get this-come from the good girl. Sure, there was just as much wild stuff packed in the rest of the episode as the seven weeks preceding. Sure, Euphoria's first season finale ended with an insane dance/flashback/memory/rabbit hole sequence, scored with an original song from series star Zendaya and Labrinth, who composed much of the show's original music.
